Terms of Service

These Terms of Service (“Terms”) govern your use of Evertree (the “Service”), operated by [Famori — replace with your registered legal entity name](“we ”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Evertree

You must be at least 16 years old, or the age of digital consent in your country, to create an account. If you add information about other living people, you confirm you have a reasonable basis to do so and will respect their wishes if they ask to be removed.

2. Your account

You are responsible for the activity under your account and for keeping your sign-in secure. A family archive has one or more “keepers” (editors) and may have viewers; keepers can add and change the people, stories, and media in that archive. You are responsible for who you invite and what role you grant them.

3. Your content

You retain ownership of the names, stories, photos, videos, recordings, and other content you add (“Your Content”). You grant us a limited licence to store, process, display, and back up Your Content solely to operate and improve the Service for you and the members of your archive. You are responsible for having the rights to the content you upload and for ensuring it does not infringe anyone else’s rights.

4. AI features

Evertree uses AI to suggest questions and to help you record and organise stories, and offers other AI features over time. AI output can be inaccurate or incomplete and should not be relied on as fact. Features that consume AI credits are described at the point of use; some features are labelled “coming soon” and are not yet available.

5. Payments

Evertree offers a free tier and a one-time “Lifetime” purchase, plus optional add-ons such as extra keeper seats, extra storage, and AI credit packs. Prices are shown before purchase. Payments are processed by Stripe; we do not store your full card details. All purchases are one-time and are governed by our Refund Policy — in short, all sales are final.

“Lifetime” means for the operational lifetime of the Service; it is not a guarantee that the Service will operate indefinitely. If we ever discontinue the Service, we will give reasonable notice and a way to export your archive.

6. Acceptable use

You agree not to:

• upload unlawful, infringing, or harmful content;
• add or expose information about a living person who has asked not to be included;
• attempt to access other archives, disrupt the Service, or circumvent limits, security, or payment;
• use the Service to harass, defraud, or impersonate others.

7. Termination

You may stop using the Service and delete your archive at any time. We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully. Some purchases are non-refundable as set out in the Refund Policy.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that content and AI output will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, [Famori — replace with your registered legal entity name] will not be liable for indirect, incidental, or consequential damages, or for loss of data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of [Malaysia — replace with your governing-law jurisdiction], and any disputes will be handled by the courts of that jurisdiction, without limiting any mandatory consumer-protection rights you have where you live.
